Welcome to the Serendipity Photography website. These Terms of Service (“Terms”) govern your access to and use of our website and photography services. By accessing our site or booking a session, you agree to be bound by these Terms.
1. Services
Serendipity Photography provides portrait photography services, including family, children, and high school senior sessions. Specific details regarding session length, location, number of edited images, and deliverables will be confirmed in your booking agreement or invoice.
2. Booking and Payment
A signed agreement and a retainer are required to secure your session date. The retainer is applied toward your total session fee or product collection as specified in your agreement. Payment terms, accepted methods, and due dates are outlined in your signed booking agreement.
3. Cancellations and Rescheduling
If you need to cancel or reschedule, please notify us as soon as possible. Retainers are non-refundable. Cancellation and rescheduling terms, including any applicable fees, are outlined in your signed booking agreement. Rescheduling is subject to availability.
4. Copyright and Image Usage
Serendipity Photography retains the full copyright to all images created. You will receive a print release and a personal-use license for the digital images delivered. This license permits you to print, share, and display the images for personal, non-commercial purposes. Commercial use, resale, or alteration of images without our express written permission is prohibited.
With your permission, we may use images from your session in our portfolio, on our website, and on social media for marketing purposes. If you prefer to keep your images private, please notify us in writing before your session.
5. Client Responsibilities
You agree to cooperate with Serendipity Photography during the session, including providing access to locations and ensuring all participants are present and ready at the scheduled time. You are responsible for any permits or fees required for the chosen location. For sessions involving minors, you confirm that you are the parent or legal guardian and have the authority to consent to photography.
6. Limitation of Liability
Serendipity Photography will make every reasonable effort to deliver high-quality images. However, we are not liable for circumstances beyond our control, including but not limited to: equipment failure, weather conditions, illness, or acts of God. In the unlikely event of a total loss of images, our liability is limited to a full refund of any payments made. We are not responsible for injuries or damages incurred during the session.
7. Digital File Storage
We store digital files for a limited time after your session. You are responsible for downloading and backing up your delivered images promptly. We are not liable for the loss of files after the delivery period specified in your agreement.
8. Governing Law
These Terms and any disputes arising from them are governed by the laws of the State of Texas. Any legal action must be brought in the state or federal courts located in Fort Bend County, Texas.
9. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date.
